Local 1549 has been advised that current and former AFSCME Local 1549 bargaining unit members who work, or worked, at the New York City Human Resources Administration (HRA) and who previously signed up and joined the lawsuit alleging violations of the Fair Labor Standards Act (FLSA) with the law firms of McGillivary Steele Elkins LLP in Washington, DC and Spivak Lipton LLP in New York have reached a tentative settlement over backpay and liquidated damages for unpaid overtime work and the late payment of overtime. Anyone with questions about the settlement should contact the firms office at [email protected]. or by phone at 202-833-8855. Clerical Associates and Eligibility Specialists who did not sign up for this case are not covered by this settlement but they can still contact the firm in writing at [email protected] who will be collecting information for a possible follow up lawsuit.

The lawsuit will seek backpay and liquidated damages for unpaid overtime work and the late payment of overtime.
The case is being prepared and handled by the law firms of McGillivary Steele Elkins LLP in Washington, DC and Spivak Lipton LLP in New York.
This case is not a class action. In order to participate you must submit a “Request to Become Party Plaintiff and Proposed Retainer Agreement” and a “Contingent Fee Retainer Agreement” to the law firm of McGillivary Steele Elkins, LLP.
